Kelsen wrote a book, much less known than his Reine Rechtslehre (Pure Theory of Law), called Was ist Gerechtigkeit (What is Justice), in which he attempts to show how and why several theories of justice, formulated by authors ranging from Greece to European Illuminism, are wrong. One of those concepts is Aristotle’s, as exposed in his Nichomachean Ethics. In this article, I argue that in order to show Aristotle wrong, Kelsen misinterprets his theory, then ignores the practical consequences it implies. (...) I attempt to demonstrate that, although highly influenced by the (retrograde) mores of his time, Aristotle’s theory can be useful to us today, which Kelsen denies. Em sua obra magna, O mundo como vontade e representação, Arthur Schopenhauer entende a sua filosofia como um sistema orgânico e afirma que o mundo é vontade e aparece como representação, ou seja, tudo é vontade e, por conseguinte, manifestação da vontade. De modo especial, o autor define uma das formas mais penetrantes da vontade, assim chamada de Vontade de vida, entendida como uma força obscura e cega; um impulso terrível e dramático, que move os indivíduos de forma dolorosa (...) e brutal. Este desejo extremamente rude e irrefletido é condicionado pelo instinto de conservação. Um dos problemas a ser ressaltado é de que existe uma condição existencial relacionada a vida humana que é o sofrimento humano e a espécie humana seria a mais suscetível ao sofrimento. A vida é um perpétuo combate e cada indivíduo é apenas um instrumento da vontade que luta para impor o que parece necessário, já que todo o querer nasce de uma necessidade. Em todos os graus de objetivação da vontade, existe necessariamente uma luta contínua entre os indivíduos de todas as espécies. O ponto de partida de toda luta está no egoísmo, representado na figura de Éris. Em virtude de a essência íntima da natureza, a Vontade de vida, ter como expressão máxima o impulso sexual. Os poetas e filósofos antigos, dentre eles Hesíodo, Parmênides, Péricles, Aristóteles, afirmaram que Eros seria o primeiro, o criador, o princípio do qual provêm todas as coisas. A natureza, cuja essência íntima é a Vontade de vida, compele com todas as forças o homem e o animal para a propagação da espécie. Tal vontade de vida, preocupa-se exclusivamente com a conservação da espécie e, neste caso, o indivíduo pode ser considerado em vão. (shrink)

Michel Foucault had a great influence upon a wide range of disciplines, and his work has been widely interpreted and is frequently referred to, but it is often difficult for beginners to find their way into the complexities of his thought. This is especially true for readers whose background is Anglo-American or "analytic" philosophy. C. G. Prado argues in this updated introduction that the time is overdue for Anglo-American philosophers to avail themselves of what Foucault offers. In this clear (...) and greatly-revised second edition, Prado focuses on Foucault's "middle" or genealogical work, particularly Discipline and Punish and Volume One of The History of Sexuality, in which Foucault most clearly comes to grips with the historicization of truth and knowledge and the formation of subjectivity. Understanding Foucault's thought on these difficult subjects requires working through much complexity and ambiguity, and Prado's direct and accessible introduction is the ideal place to start. This work consists of the first lipogrammatic translation and the first ever made into the Portuguese language of Book VII of the work _De aetatibus mundi et hominis_, credited to the late and African writer Fulgentius, the Mytographer. _De aetatibus_ is a consecutive lipogram that has a prologue and other 14 Books, with constriction in the initial 14 letters of Fulgentius’ alphabet. In this seventh section of the work, Fulgentius discusses the biblical age of the judges, avoiding the use of (...) lexical units containing the letter 'g', which was cultivated in the proposed translation text, which was developed from the critical edition by Rudolf Helm. Para tanto, breves considerações sobre o argumento e a resposta céticos do Wittgenstein de Kripke, associadas a considerações sobre fundacionismo e sobre questões constitutivas referentes à normatividade, serão realizadas. Ao final, o texto discutirá brevemente perspectivas sobre como elementos que caracterizam a normatividade poderiam ser explicados adotando-se a via disposicional.AbstractThe (...) main problem of this work is to make some considerations about the philosophical problem of normativity, as it appears in Saul Kripke’s Wittgensensein on Rules and Private Language (1982). This book examines the reactions of the friends and family of those who elect to die due to terminal illness. These surviving spouses, partners, relatives and friends, in addition to coping with the death of a loved one, must also deal with the loved one's decision to die, thus severing the relationship. C. Concern with elective-death decisions usually focuses on individuals' competence and understanding of their situations and prospects. If problematic influences on individuals are considered, they almost invariably have to do with matters such as depression and the effects of medication. Too little attention is paid to how individuals, as subjects, are products of both external cultural and social influences on them, and of internal efforts and needs that determine their subjectivity.

Contemporary health care often lacks generosity of spirit, even when treatment is most efficient. Too many patients are left unhappy with how they are treated, and too many medical professionals feel estranged from the calling that drew them to medicine. Arthur W. Frank tells the stories of ill people, doctors, and nurses who are restoring generosity to medicine--generosity toward others and to themselves. The Renewal of Generosity evokes medicine as the face-to-face encounter that comes before and after diagnostics, pharmaceuticals, (...) and surgeries. Frank calls upon the Roman emperor Marcus Aurelius, philosopher Emmanuel Levinas, and literary critic Mikhail Bakhtin to reflect on stories of ill people, doctors, and nurses who transform demoralized medicine into caring relationships. In At the Will of the Body , Arthur Frank told the story of his own illnesses, heart attack and cancer. That book ended by describing the existence of a "remission society," whose members all live with some form of illness or disability. The Wounded Storyteller is their collective portrait. Ill people are more than victims of disease or patients of medicine they are wounded storytellers. People tell stories to make sense of their suffering when they turn their diseases (...) into stories, they find healing. Drawing on the work of authors such as Oliver Sacks, Anatole Broyard, Norman Cousins, and Audre Lorde, as well as from people he met during the years he spent among different illness groups, Frank recounts a stirring collection of illness stories, ranging from the well-known--Gilda Radner's battle with ovarian cancer--to the private testimonials of people with cancer, chronic fatigue syndrome, and disabilties. Their stories are more than accounts of personal suffering: they abound with moral choices and point to a social ethic. Frank identifies three basic narratives of illness in restitution, chaos, and quest. Restitution narratives anticipate getting well again and give prominence to the technology of cure. In chaos narratives, illness seems to stretch on forever, with no respite or redeeming insights. Quest narratives are about finding that insight as illness is transformed into a means for the ill person to become someone new. (shrink)

La época comprendida entre el siglo XVII y la primera mitad del XVIII terminó siendo bautizada por Heinrich Wölfflin como Barroco, aunque el concepto ya existía previamente con otras acepciones y no como estilo. A partir de las obras del escritor suizo Renacimiento y Barroco (1888) y de Conceptos fundamentales de la historia del arte (1915) el concepto comenzó a adquirir unas dimensiones insospechadas hasta el punto de (...) que a nuestra época se la ha denominado neobarroco, por las analogías con aquélla. En el presente trabajo voy a utilizar el concepto de barroco como un instrumento de corte, ante todo, estético y estilístico que, al mismo tiempo, va unido a cuestiones epocales y anímicas con objeto de analizar determinadas propuestas artísticas en diferentes campos, como la pintura y la música, mostrando que la proyección del concepto abarca ámbitos de la realidad de gran eficacia hermenéutica. This paper discusses practical akrasia from the perspective of the sophisticated form of moral subjectivism that can be derived from Nuno Venturinha’s remarks on moral matters.

Pragmatist views inspired by Peirce characterize the content of claims in terms of their practical consequences. The content of a claim is, on these views, determined by what actions are rationally recommended or supported by that claim. In this paper I examine the defeasibility of these relations of rational support. I will argue that such defeasibility introduces a particularist, occasion-sensitive dimension in pragmatist theories of content. More precisely, my conclusion will be that, in the sort of framework naturally derived from (...) Peirce’s pragmatist maxim, grasping conceptual contents is not merely a question of mastering general rules or principles codifying the practical import of claims, but decisively involves being sensitive to surrounding features of the particular situation at hand. Schopenhauer argues, in uniquely powerful prose, that self-consciousness gives the illusion of freedom and that human actions are determined, but that we rightly feel guilt because our actions issue from our essential individual character. He locates moral value in the virtues of loving kindness and voluntary justice that spring from the fundamental incentive of compassion. Morality's basis is ultimately metaphysical, resting on an intuitive identification of the self with all other striving and suffering beings. The Introduction by leading Schopenhauer scholar (...) Few philosophers are as widely read or as widely misunderstood as Friedrich Nietzsche. When Danto's classic study was first published in 1965, many regarded Nietzsche as a brilliant but somewhat erratic thinker. Danto, however, presented a radically different picture, arguing that Nietzsche offered a systematic and coherent philosophy that anticipated many of the questions that define contemporary philosophy. Danto's clear and insightful commentaries helped canonize Nietzsche as a philosopher and continue to illuminate subtleties in Nietzsche's work as well as his (...) immense contributions to the philosophies of science, language, and logic. This new edition, which includes five additional essays, not only further enhances our understanding of Nietzsche's philosophy; it responds to the misunderstandings that continue to muddy his intellectual reputation. Even today, Nietzsche is seen as everything from a precursor of feminism and deconstruction to a prophetic writer and spokesperson for disgruntled teenage boys. As Danto points out in his preface, Nietzsche's writings have purportedly inspired recent acts of violence and school shootings. Danto counters these misreadings by elaborating an anti-Nietzschian philosophy from within Nietzsche's own philosophy "in the hope of disarming the rabid Nietzsche and neutralizing the vivid frightening images that have inspired sociopaths for over a century." The essays also consider specific works by Nietzsche, including _Human, All Too Human_ and _The Genealogy of Morals_, as well as the philosopher's artistic metaphysics and semantical nihilism. Our study considers the governance, ethics and operational challenges associated with the acquisition, manipulation and commodification of ‘big data’ in the financial services sector. To the best of our knowledge, there are no published studies describing empirical research undertaken within companies in this sector to understand how they are responding to such challenges: our field-based research is a significant initial contribution in this respect. We describe the results of a micro-ethnographic study undertaken in a small-to-medium-sized company developing disruptive, technology-related platforms (...) and services in the banking and retail sectors based on big data and associated analytics: these are used to derive commercially valuable insights from personal customer data in exchange for cash back and targeted rewards. The company was found to employ a multi-level innovation governance approach, underpinned by an ethical strategy based on a principle of mutual benefit. Opt-in and informed consent for using data for specific purposes was supported by principles of data minimisation and anonymisation, with unrestricted use of secondary, anonymised and aggregated data to develop insights. Governance, which included contextual data protection legislation, payment-card industry data usage standards and internal corporate controls, presented as bespoke organisational practices relating to data security and privacy. These in total set the governance and ethics frame for big data innovation at the company within which it has had to be both adaptive and responsive under conditions of normative and regulatory uncertainty. This paper consists in an exposition of a proof Newton gave in 1666 of the parallelogram law for compounding velocities, and an examination of its implications for understanding his treatment of motion resulting from a continuously acting force in the Principia. I argue that the “moments” invoked in the fluxional proof of the vector resolution and composition of velocities are “virtual times”, a device allowing Newton to represent motions by the linear displacements produced in such a time; the ratio of (...) velocities at an instant can then be represented by assuming the velocities continue for such a virtual time. By the Method of First and Ultimate Ratios, the first ratio of the velocities is then given by the ratio of such lines, under the presupposition that in the limit they will shrink to zero magnitude. I then argue that the same device is implicit in Newton’s appeal to “moments” or “particles of time” in his proof of Kepler’s Area Law in the “Locke Paper” and in Proposition 1 of Book 1 of the Principia, and that the limiting process involved there is therefore the same as that implicit in the Method of First and Ultimate Ratios. A circunscrição do tema do circuito da ipseidade em O Ser e o Nada pode esclarecer as inovações sartre a nas em relação ao estatuto da Metafísica, da Ontologia e da Fenomenologia. Apresentamos aqui algumas direções dessa tarefa assumida por Sartre, ao tratar da passagem da fenomenologia à ontologia, sobre tudo sua defesa da irredutibilidade do fenômeno do ser ao ser do fenômeno, que culmina na ontologia fenomenológica e que é o télos de O Ser e o Nada. A passagem (...) à metafísica pode ser bem delineada através da contraposição com a empresa bergsoniana, já que a metafísica aparece na reflexão de Sartre com uma função puramente reguladora, jamais constitutiva. Surveys and extens work that has been done in the past two years on 'tense logic' and is a sequel to the author's book, Time and Modality.

It is widely held that there is a distinctive norm of assertion. A plausible idea is that there is an analogous, perhaps weaker, norm for indirect communication via implicatures. I argue against this type of proposal. My claim is that the norm of assertion is a social norm governing public updates to the conversational record. Off the record implicatures are not subject to social norms of this type. I grant that, as happens in general with intentional actions, off the record (...) communicative acts may be subject to normative assessments on different levels (for instance, regarding their moral or prudential appropriateness). However, such assessments do not generate distinctive norms that apply to all cases of implicature. (shrink)

Written in 1839 and chosen as the winning entry in a competition held by the Royal Norwegian Society of Sciences, Schopenhauer's Prize Essay on the Freedom of the Will marked the beginning of its author's public recognition and is widely regarded as one of the most brilliant and elegant treatments of free will and determinism. Schopenhauer distinguishes the freedom of acting from the freedom of willing, affirming the former while denying the latter. He portrays human action as thoroughly determined but (...) also argues that the freedom which cannot be established in the sphere of human action is preserved at the level of our innermost being as individuated will, whose reality transcends all dependency on outside factors. This volume offers the text in a previously unpublished translation by Eric F. J.
